These Terms of Service (“Terms”) govern your use of Twistly (“the App”, “we”, “us”, or “our”), an AI-powered application that generates presentations in response to user requests. Twistly is available through several channels, including the web app, the Microsoft PowerPoint add-in, and integrations with third-party platforms such as ChatGPT. By accessing or using Twistly through any of these channels, you agree to these Terms.

Service Description

Twistly uses artificial intelligence to generate presentation content based on the input you provide, such as a topic, text, or an uploaded file. All content is generated automatically. The App is intended to help you create draft presentations and is provided for informational and productivity purposes only.

Eligibility and Accounts

You must be at least 13 years old (or older if required by the laws of your country) to use Twistly. If you are under 18, you may only use the App with the consent of a parent or legal guardian who agrees to these Terms on your behalf. If you use the App on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

Acceptable Use

You agree not to use Twistly to create, upload, or distribute content that is unlawful, infringing, harmful, or that violates the rights of others. You are solely responsible for the input you provide and for ensuring you have the rights to any material you upload.

In addition, you agree not to:

— reverse engineer, decompile, or otherwise attempt to extract the source code, underlying models, or prompts of the App;

— use automated means (such as bots, scrapers, or scripts) to access the App, or circumvent any usage limits, quotas, or technical restrictions;

— resell, sublicense, or otherwise provide access to the App to third parties, except as expressly permitted by your plan;

— use the App to develop or train a competing product or service;

— use the App to generate spam, deceptive content, or content intended to mislead others about its origin;

— interfere with or disrupt the operation, security, or integrity of the App.

We may investigate violations of this section and take appropriate action, including suspending or terminating access.

Your Content and Ownership

You retain ownership of the input you provide and of the presentations Twistly generates for you. Subject to these Terms, we do not claim ownership of your presentations. You grant us a limited license to process your input and generated content solely to provide and improve the service. Details on how we collect, use, and protect your data are described in our Privacy Policy, which forms part of these Terms.

You are responsible for reviewing and validating all generated content before using or sharing it. The App should not be relied upon for legal, medical, financial, or other professional advice.

AI-Generated Content

Because content is generated by artificial intelligence:

Output may not be unique. Due to the nature of AI, the App may generate the same or similar content for other users. Your ownership of a generated presentation does not prevent other users from independently receiving similar output, and we cannot guarantee exclusivity of generated content.

Output may contain errors. Generated content may be inaccurate, incomplete, or outdated. You should independently verify any facts, figures, or claims before relying on them.

No guarantee of non-infringement. We do not warrant that generated content does not infringe the rights of third parties. You are responsible for reviewing generated content and ensuring that your use of it complies with applicable law and does not violate third-party rights, including intellectual property rights.

Third-Party Platforms

When you access Twistly through a third-party platform, such as ChatGPT (OpenAI) or Microsoft PowerPoint, your use of that platform is also governed by that platform’s own terms and privacy policies. We are not responsible for third-party platforms, and their terms apply in addition to these Terms.

Subscriptions and Payment

Twistly offers free and paid subscription plans (including Starter, Pro, and Team). Paid plans are billed on a recurring basis according to the plan you select, and renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. Details on billing, renewals, and refunds are described in our Fulfillment Policy. We may change plan features or pricing with reasonable notice.

No Warranties

The App is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or suitability of the generated content.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from the use of or inability to use the App.

Modifications and Availability

We may modify, suspend, or discontinue the App or any part of its functionality at any time. We may also update these Terms from time to time; continued use of the App after changes take effect constitutes acceptance of the revised Terms.

Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time.

Sections of these Terms that by their nature should survive termination will survive, including Your Content and Ownership, AI-Generated Content, No Warranties, Limitation of Liability, and this Termination section.
